We have seen all kinds of crazy versions of CAPA forms. Some have crossed over the line by including information more appropriate for an employment agreement. Remember, the CAPA-NS applies only to prescribing - not APRN practice. When it comes to your PRESCRIPTIVE AUTHORITY, here's what you need to know.

It’s official, there is a Common CAPA-NS Form

The Collaborative Prescribing Agreement Joint Advisory Committee (CAPA Committee), which is comprised of three (3) APRNs and three (3) physicians, was established* with the passage of Senate Bill 7 in 2014. The committee was mandated by the law to establish a list of physicians willing to sign a CAPA-NS.  This task was accomplished and the list may be accessed, through the Kentucky Board of Nursing, by APRNs who are unable to locate a signer on their own.

The CAPA Committee was also empowered to develop a common CAPA-NS form. After review, the CAPA Committee accepted KCNPNM's CAPA-NS as its recommended common form.  In subsequent meetings, both the Kentucky Board of Nursing and the Kentucky Board of Medical Licensure approved the same version of the common CAPA-NS form. Thus, this “Common CAPA-NS” form is now the official CAPA-NS form housed on the KBN website. 

APRNs initiating new prescribing agreements for nonscheduled legend drugs shall now use the Common CAPA-NS form.

Existing agreements do not have to be changed to the new form.

…(2) The committee may make recommendations to the Kentucky Board of Nursing and the Kentucky Board of Medical Licensure about the CAPA-NS agreements and shall perform other duties as required by this section.

The committee may recommend a common CAPA-NS form for use by all advanced practice registered nurses and all physicians in Kentucky who enter into a CAPA-NS. The common CAPA-NS form shall only be required for CAPA-NS agreements if both the Kentucky Board of Nursing and the Kentucky Board of Medical Licensure approve the same version of the common CAPA-NS form...
